Digital Will vs Dead Man's Switch: Which Does What

They solve different problems: a will decides who gets what, a dead man's switch makes sure the message arrives. How the layers fit together.

These two terms get used almost interchangeably, and they shouldn't be, because they answer different questions. The shortest version:

  • A will answers "who is entitled to what?" It's an instrument of law.
  • A digital will answers "what exists, and what do I want done with it?" It's an instrument of documentation.
  • A dead man's switch answers "how does anyone find out, and when?" It's an instrument of delivery.

Confuse them and you get plans with a hole in the middle: a legally perfect will nobody can act on, or a perfectly delivered message with no legal force. Here's each layer, and how they interlock.

The legal will: authority

Only a will, or a trust, or your jurisdiction's equivalents, actually transfers ownership. Courts, probate, and executors are the machinery that decides who gets things, and no app replaces it. Its weaknesses for digital life are timing and blindness. Probate takes months, and a will only covers what its executor can find. One practical rule from that mismatch: passwords and secrets don't belong in the will itself. In many places a will becomes a public document in probate. The will should say who. Other layers carry how.

The digital will: documentation

"Digital will" usually isn't a legal term. It's the inventory-and-instructions layer: what accounts, subscriptions, wallets, and files exist, what you want done with each (delete, memorialize, transfer, publish), and who should handle what. Some platforms have their own native versions, such as legacy-contact and inactive-account settings. Those are worth configuring and are also plainly limited, because each covers one platform, on that platform's terms.

The documentation layer's weakness is staleness and delivery. A beautifully maintained inventory in a drawer helps no one, and one that reaches your family two years late helps little. Which is the cue for the third layer.

The dead man's switch: delivery

A dead man's switch monitors that you're still there through periodic check-ins, and when you stop responding it starts a release process, notifying chosen people and delivering what you staged for them. Its job is timing and transmission. Done well it has properties the other layers lack: it works in days rather than probate-months, it can carry sealed material that stays sealed until triggered, and it doesn't depend on anyone knowing to go looking.

Design quality matters. The difference between a naked timer and staged escalation, meaning multiple attempts to reach you and then trusted contacts in sequence, is the difference between a false alarm and a controlled handoff. That escalation design is the part we care most about at

Its limits are just as concrete. A switch confers zero legal authority. The recipient of your instructions still has to work within the will, probate, and platform terms of service. It also shouldn't be the sole holder of raw credentials or keys. Deliver instructions and pointers, or encrypted and split material, rather than the crown jewels in plaintext.

A reasonable order of operations. Document first, at the digital will layer, where even a plain text file beats nothing. Put delivery under it, so the documentation actually reaches people. Then get the legal layer done for anything with real value. That last one involves a professional, and the first two make their work faster and cheaper.
